Information about processing of personal data, cf. Article 13 and 14 of the EU General Data Protection Regulation (2016/679)

When you use webpages run by Hamilton (LG Harris & Co Ltd). or you are in contact with us by receiving our newsletters, promotions or purchase merchandise from us we will process personal data about you.

Hamilton (LG Harris & Co Ltd). is responsible for processing your personal data (data controller). Below you will find a description of how Hamilton (LG Harris & Co Ltd). process your personal data.

1.   Which categories of personal data is processed?

• General data, identity and contact information (such as name, email address, address, phone number)
• Payment data (such as credit card number)
• Purchase data in our internet store

2.   The personal data will be processed for the following purposes:

• To send out marketing material, newsletters and provide information about our business.
• To answer a request from you, which is based on legitimate interests.

3.   Storage time

The data stored will be deleted when replaced by more relevant data. Unless longer storage is imposed by law, all personal data will be deleted or anonymized within 12 months, once you withdraw consent or after any contract has been fulfilled.

Where enquiries have been made or transactions have been placed by customers the data will be stored for the longevity of the contract or until the enquiry has been answered.

The legal basis is the EU personal data Regulation (2016/679) Article [6 (a) (b), (c) and (f),] and corresponding national legislation:

• (c) The processing is necessary to comply with any legal obligations
• (f) The processing of your contact information is necessary for the purposes of the legitimate interests pursued by Orkla, and in particular for answering your requests or enquiries.

If our information processing is based on your consent, you also have the right to at any time revoke your consent to our further processing of your personal data.

If our information processing is connected to a contract or legal obligation and you fail to provide certain information when requested, we may not be able to perform the contract we have entered with you.

5.   How is your personal data collected?

The personal data is collected directly from you:

• Through an opt in option on this website
• Through you contacting us directly in relation to an order or enquiry by for example telephone, email, mail and fax

6. Volunteered & Requested Data

While interacting with our social media channels a user may send Hamilton personal information to enter a competition, enquire about a product or service or seek help from us. In these situations, Hamilton will use personal data responsibly to resolve the user’s enquiry and then remove that data after the matter is resolved and in line with our GDPR commitments. All data will be stored on a secure server controlled by Hamilton, our parent company Orkla, or by our data processor.

Example A. Hamilton have run a competition on a Hamilton owned social channel and the winner has been contacted. Hamilton will request the personal data necessary to send the prize to the winner.

Example B. A user has contacted Hamilton with a product enquiry. Additional information is needed by the Care team to resolve the enquiry. All data is held securely by Hamilton until the enquiry is resolved and our GDPR obligations have been fulfilled, at which point it will be permanently deleted.

In some situations, Hamilton may ask for permission to use personal information in our marketing activities. In these situations, an informal discussion may take place between Hamilton and the individual or group where upon Hamilton will ask the individual or group to review our privacy policy prior to sending written consent for the data to be held. Data could include names, company names, emails, contact numbers and image data. If consent is given this data is held on a secure server controlled by Hamilton, our parent company Orkla, or by our data processor.

Example A. Hamilton have contacted an influencer via a social media direct message and have asked permission to use some of the influencers copywritten content under certain conditions, a link to the influencers social channel may be provided when the content is used. Hamilton provide a link to this document and when the influencer is satisfied the data will be handled appropriately, they agree via the direct message conversation. Hamilton then log their agreement and the content to which they have agreed to share in a secure location on the Hamilton server. The content and any other user details agreed to are then shared through Hamilton marketing channels.

Example B. An end user shares a written story with a Hamilton social channel or in a Facebook group to which Hamilton have access. Hamilton approach the user privately and ask for permission to use their comments and name as a testimonial. The user is provided a link to this document and after reading agree to let Hamilton use their statement. The statement, a name and other personal details may be taken depending on the situation, the user would volunteer this information to Hamilton. All the data gathered would then be stored in a secure location on the Hamilton server and the statement used in Hamilton activity as per the agreement.

7.   Transfer of personal data

We will not share your personal data with third parties without a legal basis for such transfer. Examples of such legal basis will typically be an agreement with you or a legal obligation to transfer such personal data.

We also use data processors who process personal data on our behalf and only after instruction, examples of these processors are those who help fulfill orders, deliver packages, sending postal mail and email, provide marketing assistance, process credit card payments and suppliers of IT systems or applications, agencies and data process companies, when such data processors are used we enter into an agreement to ensure sufficient information security.

The personal data is processed on Microsoft servers within the EU/EEA area. The personal data is processed on Microsoft servers within the and outside the EU/EEA area. Appropriate safeguards are in place for personal data processed outside the EU/EEA. Standard data protection clauses adopted by the Commission / EU-US Privacy Shield authorization is in place. 8.   Your rights

You have the right to gain access and to rectify or erase personal data, and to restrict or object to processing, or request transfer of personal data to another party (data portability), if certain requirements are fulfilled.

We may need to request specific information to confirm your identity when you are exercising your rights as set out above to ensure that personal information is only disclosed to you.
